Terms of Use

1. Acceptance of Terms

By accessing or using the Whyte Law client portal (“Portal”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must not access or use the Portal. These Terms govern your use of the Portal and all services made available through it.

2. Nature of the Portal

The Portal is a secure digital platform provided by Whyte Law (“the Firm”) to facilitate communication, document exchange, matter updates, and billing between the Firm and its clients. Access to the Portal does not, by itself, create a solicitor-client relationship. A solicitor-client relationship is established only upon execution of a formal Letter of Engagement or Legal Services Agreement.

3. Authorised Access

Access to the Portal is granted solely to persons who have been issued credentials by the Firm. You must not share your login credentials with any third party. You are responsible for all activity that occurs under your account. You must notify the Firm immediately at info@whytelawgroup.com if you suspect unauthorised access to your account.

4. Confidentiality

All information, documents, and communications accessible through the Portal are strictly confidential. You must not disclose, reproduce, or distribute any content from the Portal to any person other than as expressly authorised by the Firm. The Portal is protected by legal professional privilege and confidentiality obligations under Jamaican law.

5. Billable Communications

Messages and queries submitted through the Portal may be assessed as billable legal advice at the Firm’s discretion. Where a communication is determined to constitute substantive legal advice, you will be notified within the Portal and the applicable charge will be reflected in your statement of account. By sending a message through the Portal you acknowledge this possibility.

6. Document Submissions

Documents uploaded through the Portal must be accurate and complete. The Firm accepts no liability for delays, errors, or losses arising from the submission of inaccurate, incomplete, or fraudulent documentation. You warrant that you have the right to share any document you upload.

7. Acceptable Use

You agree not to:

  • Use the Portal for any unlawful purpose or in contravention of applicable Jamaican law;
  • Attempt to gain unauthorised access to any part of the Portal or its underlying systems;
  • Introduce malware, viruses, or any harmful code;
  • Scrape, harvest, or systematically extract data from the Portal;
  • Impersonate any person or misrepresent your identity or authority.

8. Availability

The Firm does not warrant that the Portal will be available at all times without interruption. Scheduled maintenance or unforeseeable technical issues may affect access. The Firm will endeavour to provide reasonable notice of planned downtime where possible.

9. Limitation of Liability

To the fullest extent permitted by Jamaican law, the Firm shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of or inability to access the Portal, including loss of data. Nothing in these Terms limits the Firm’s liability for gross negligence or fraud.

10. Amendments

The Firm reserves the right to amend these Terms at any time. Continued use of the Portal following notification of an amendment constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Jamaica. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Jamaica.
